1. Who we are

These Terms & Conditions ("Terms") form a binding agreement between you and Tutor Site ("we", "us", or "our"), operator of the TutorSite platform (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Acceptance and eligibility

By creating an account or otherwise using the Service, you confirm that you are of legal age in your jurisdiction (or have parental consent) and, if acting on behalf of an organization, that you have authority to bind that organization to these Terms. You agree to provide accurate information and keep your account credentials confidential. You are responsible for all activity under your account.

3. The Service

TutorSite is an online marketplace that connects students with independent tutors. We facilitate discovery and communication; tutoring services themselves are provided by independent tutors. We do not guarantee any particular tutor's availability, qualifications, or results.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Send spam, phishing, malware, or other malicious content.
  • Infringe the intellectual property, privacy, or other rights of any person.
  • Interfere with or compromise the security of the Service, including scraping, probing, reverse engineering, or circumventing access controls.
  • Impersonate any person or misrepresent your affiliation with any entity.
  • Solicit users to transact outside the platform to evade fees.

5. Intellectual property

The Service, including all software, design, branding, and content we provide, is owned by Tutor Site or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You retain ownership of content you upload and grant us a license to host and process that content solely to operate and provide the Service.

6. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms.

Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time through the customer portal; cancellation takes effect at the end of the current billing period. Coin purchases are one-time and non-renewing.

7. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time and request account deletion by contacting support.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify and hold Tutor Site harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

11. Changes to the Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Tutor Site is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless otherwise required by mandatory consumer protection law.
